1. Acceptance of Terms

By accessing or using SOLYX ("the Bot", "our service", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). SOLYX provides Discord bot services and Twitch integration features for streamer communities. If you do not agree to these Terms, you may not use our Service. These Terms constitute a legally binding agreement between you and SOLYX.

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

2. Description of Service

SOLYX is a Discord bot and Twitch integration platform that provides various features including but not limited to:

  • Server moderation and management tools
  • Music playback and queue management
  • Economy and currency systems
  • Leveling and experience tracking
  • Twitch integration and stream notifications
  • Advanced Twitch chat moderation tools
  • Spam filters and blocked terms engine
  • Audit logs and moderation transparency
  • Streamer community management tools
  • Integration with StreamElements, YouTube, TikTok, and more
  • Custom commands and automation
  • Analytics and statistics (Discord and Twitch)
  • Premium subscription features

We reserve the right to modify, suspend, or discontinue any part of our Service at any time, with or without notice. We do not guarantee uninterrupted or error-free operation of the Service.

3. Eligibility and Account Requirements

To use our Service, you must:

  • Be at least 13 years of age (or the minimum age required in your jurisdiction)
  • Have a valid Discord account (for Discord bot features)
  • Have a valid Twitch account (for Twitch integration features)
  • Have the necessary permissions to add bots to your Discord server
  • Have the necessary permissions to manage your Twitch channel (for Twitch moderation features)
  • Comply with Discord's Terms of Service and Community Guidelines
  • Comply with Twitch's Terms of Service, Community Guidelines, and Developer Services Agreement (if using Twitch features)
  • Not be prohibited from using the Service under applicable laws

You are responsible for maintaining the security of your Discord and Twitch accounts and for all activities that occur under your accounts. You may link your Discord and Twitch accounts to access unified features across both platforms.

4. User Responsibilities and Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree to:

  • Comply with all applicable laws and regulations
  • Comply with Discord's Terms of Service and Community Guidelines
  • Comply with Twitch's Terms of Service, Community Guidelines, and Developer Services Agreement (if using Twitch features)
  • Respect the rights of other users and third parties on both Discord and Twitch platforms
  • Not use the Service to harm, harass, threaten, or violate the rights of others
  • Not use the Service for any illegal or unauthorized purpose
  • Not attempt to gain unauthorized access to our systems, networks, or third-party APIs (Discord, Twitch)
  • Not interfere with or disrupt the Service or servers
  • Not use automated systems (bots, scripts) to interact with the Bot or Twitch API excessively
  • Not reverse engineer, decompile, or disassemble any part of the Service
  • Not remove, alter, or obscure any proprietary notices on the Service
  • Not abuse Twitch API rate limits or violate Twitch's API terms and Developer Services Agreement
  • Not use Twitch moderation features to censor legitimate content or violate Twitch's Community Guidelines
  • Not share or misuse OAuth tokens for Discord or Twitch accounts

5. Prohibited Uses

You are expressly prohibited from using our Service:

  • To violate any applicable local, state, national, or international law or regulation
  • To infringe upon the intellectual property rights of others
  • To transmit any malicious code, viruses, or harmful data
  • To spam, harass, or abuse other users
  • To impersonate any person or entity or falsely state your affiliation
  • To collect or store personal data about other users without authorization
  • To use the Service in a manner that could damage, disable, or impair our systems
  • To use the Service for commercial purposes without our express written consent
  • To circumvent or attempt to circumvent any security measures

6. Premium Services and Subscriptions

SOLYX offers premium subscription tiers that provide access to additional features. By purchasing a premium subscription, you agree to the following:

  • Pricing: Subscription fees are displayed on our website and may be changed at any time with notice
  • Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually)
  • Payment: Payment is processed by third-party payment processors. You agree to provide accurate payment information
  • Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
  • Cancellation: You may cancel your subscription at any time, but cancellation does not entitle you to a refund for the current billing period
  • Refunds: All sales are final. Refunds are provided only as required by law or at our sole discretion
  • Feature Changes: We reserve the right to modify, add, or remove premium features at any time
  • Revocation: We may revoke premium access for violations of these Terms without refund

7. Service Availability and Modifications

We strive to maintain high availability of our Service but do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance and updates
  • Unforeseen technical issues or outages
  • Third-party service disruptions (e.g., Discord API issues, Twitch API issues)
  • Twitch API rate limit restrictions
  • Force majeure events

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable for any damages resulting from service interruptions or modifications.

8. Intellectual Property Rights

All content, features, functionality, and intellectual property of SOLYX, including but not limited to software, code, designs, graphics, logos, and trademarks, are owned by us or our licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not:

  • Copy, modify, or distribute any part of the Service
  • Reverse engineer or attempt to extract source code
  • Use our trademarks, logos, or branding without permission
  • Create derivative works based on the Service

9. User Content and Data

You retain ownership of any content you provide to the Service (e.g., custom commands, configurations). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.

We are not responsible for any loss or corruption of your data. You are responsible for backing up any important data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOLYX AND ITS OPERATORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or unavailability
  • Errors or omissions in the Service
  • Damages resulting from use or inability to use the Service
  • Third-party conduct or content

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation
  • Accuracy or reliability of information

We do not warrant that the Service will meet your requirements or that any errors will be corrected.

12. Indemnification

You agree to indemnify, defend, and hold harmless SOLYX and its operators, affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

13. Termination

We reserve the right to terminate or suspend your access to the Service at any time, with or without cause or notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Violation of Discord's Terms of Service or Community Guidelines
  • Violation of Twitch's Terms of Service, Community Guidelines, or Developer Services Agreement
  • Fraudulent, abusive, or illegal activity
  • Non-payment of subscription fees
  • Extended periods of inactivity
  • Abuse of Twitch API or Discord API

Upon termination, your right to use the Service will immediately cease. We may delete your data and account information, subject to our data retention policies. You may terminate your use of the Service at any time by removing the bot from your Discord server or disconnecting your Twitch account through the dashboard settings.

14. Dispute Resolution

Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration organization, except where prohibited by law. You waive your right to a jury trial and to participate in class actions.

Before initiating arbitration, you agree to first contact us to attempt to resolve the dispute informally.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SOLYX operates, without regard to its conflict of law provisions. Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of that jurisdiction.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SOLYX regarding the Service and supersede all prior agreements and understandings.

18. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.

20. Account Linking and Multi-Platform Access

SOLYX supports linking your Discord and Twitch accounts to provide unified access across both platforms:

  • Account Linking: You may voluntarily link your Discord and Twitch accounts through our dashboard. Linking accounts allows you to access features that span both platforms.
  • Unified Account: When accounts are linked, you can access your data and settings from either platform using either Discord or Twitch authentication.
  • Data Sharing: Linking accounts allows us to share relevant data between your Discord and Twitch accounts to provide integrated features (e.g., stream notifications, cross-platform moderation).
  • Unlinking: You may unlink your accounts at any time through the dashboard settings. Unlinking will remove the association but may affect features that require both accounts.
  • Primary Provider: Your primary authentication provider (Discord or Twitch) is determined by which account you first used to sign up. This cannot be changed after account creation.
  • OAuth Tokens: We store encrypted OAuth tokens for both Discord and Twitch to maintain your connections. These tokens are used solely to provide the Service and are never shared with third parties.

By linking your accounts, you consent to the sharing of necessary data between your Discord and Twitch accounts as described in our Privacy Policy.
